By using SplameiBot, you agree to both the SplameiBot Terms of Service (this webpage) and the SplameiBot Privacy Policy. You are responsible for the use of SplameiBot from members and others and that you will moderate according to follow the Terms of Service.

1. Scopes

This defined what everything means. We can’t really sum it up here so you’ll need to read this… Sorry!

Below is a list of all the definitions regarding SplameiBot. These will define the language used by the bot and maintainers.

  • Service – The functionality provided by SplameiBot. This may be commands, logs and interactions)
  • Server Owner – The person who owns a Discord server. In some instance this may be multiple people
  • Server Administrator and Moderator – People are are responsible for enforcing the rules of the Discord server
  • User – Anyone interacting and using the bot
  • You – Refers to you, the person adding SplameiBot to a Discord server or the person accepting these terms

2. Who we are

Splamei is the one who made SplameiBot and hosts it on their own server. We’re not related to anything else not owned by Splamei.

SplameiBot is maintained and owned by Splamei. The bot is hosted and run on it’s own server operated by Splamei. SplameiBot as has no relation to other brands, names and organisations not controlled by Splamei or SplameiPlay.

3. Eligibility and responsibility

You need to follow Discord rules and meet the age requirement and have rules to prevent abuse, harassment or illegal activity with the bot and sever

Only mods (with Admin or Manage Server permissions) can accept these terms and you will take personal responsibility for the bot’s use. We won’t hold you responsible for other people’s usage as long as you stop violations when you know about it

Users who violate these terms can be blocked from using the bot with their data deleted

If you find someone or a server violating the acceptable usage, you must report it to us via the official report page. We won’t show any identifying information to the user or server your reporting. We’ll also store the information provided following our website’s Privacy Policy.

If the one who accepted the terms leaves or looses the permissions required, you may need someone else to re-accept them

Wow this summary is a meaty one

To use SplameiBot, you must meet all of the following requirements:

  • You must all be following Discord’s Terms of Service and Community Guidelines
  • You must be above or at the age requirement set by Discord’s Terms of Service
  • You must have appropriate rules and regulations to prevent all forms of abuse, harassment and illegal activity towards and from members and SplameiBot

Only users with the ‘Administrator’ and ‘Manage Server’ permissions may accept these terms, By accepting, you enter into this agreement in your personal capacity and acknowledge that you are solely responsible for the usage and ensuring compliance within these terms in connection to the server(s) you accept these terms for. No other user, administrator, moderator or member enter this agreement. You, however, will not be held responsible for the actions taken by others outside of your reasonable control, provided you take appropriate steps to prevent or stop violations when you become aware of them and do not endorse such activities.

Users who violate this TOS, even if they have not explicitly accepted it, may be blocked from accessing and using the bot. Relevant user data may also be deleted, either automatically or manually via the /terms command, unless the user has previously opted out. No further action will be taken by Splamei or the bot beyond access restrictions and data deletion.

If you identify someone or a Discord server violating the acceptable usage of SplameiBot, you must report it directly to us via our official SplameiBot report page. Any identifying information will only be viewable by us and not by the user or server you reported. Information stored will be subject to our website Privacy Policy.

If the accepting user leaves or looses the ‘Administrator’ or ‘Manage Server’ permissions, you may be required to reject or re-accept the terms by another member with said permissions. You do not need to be the one who accepted the terms to reject them.

4. Licence

You will get a limited personal license to use SplameiBot but only in the servers you manage and for it’s intended use. You can’t share this with others and it can be revoked at any time

When compiling with these terms, you are given a limited, non-exclusive, non-transferable, revocable license to use SplameiBot solely for it’s intended usage on the Discord server(s) that you add SplameiBot too and have have the rights to do so.

5. Acceptable Use

Don’t do any of what’s listed here. That’s it really

You may use SplameiBot to entertain and engage users however, you may not use SplameiBot for the following:

  • Any form of misuse, spam, raids, abuse or malicious activity
  • Attempt to reverse-engineer, hack or exploit the bot
  • Indirect or direct usage of the bot to harass, discriminate or hate on others
  • Any form of usage to promote or relate towards scams, phishing attempts or malware
  • Using the bot to violate applicable law
  • Use for actions that violate Discord’s Terms of Service, API terms or Developer Policies

6. Moderation and Automation

When using SplameiBot’s ‘Server Flags’ feature, you’re doing it at your own risk. We can’t be held accountable for the (moderator) action taken. You also acknowledge that SplameiBot will scan messages for known spam / raid content and moderators or users may independently send content to us for review.

By using SplameiBot’s ‘Server Flags’ feature, you acknowledge and agree that:

  • The messages and images sent in the server may be processed for spam and abuse detection
  • Moderators and users can independently forward content to us for review where reasonably necessary
  • The bot may apply automated moderator action on users when a violation was found
  • You are responsible for the use of this feature and the actions taken. Splamei cannot be held responsible (as listed below)

7. Bot functionality and Liability

SplameiBot may not always be online and we can change or remove features at any time

You can’t hold us or related parties responsible for any problems, damages or losses when you’re using the bot. You will also protect and cover us from any claims or costs coming from your usage of the bot or breaking these terms

We can’t be held liable for the reasons listed below

SplameiBot is provided “as-is” with no warranties of any kind.

We give no guarantee of SplameiBot’s uptime or permanent availability. We reserve the right to revoke your usage of SplameiBot, shutdown SplameiBot and change or discontinue features of SplameiBot as we see fit.

You agree to indemnify, defend and hold harmless Splamei and affiliated partied from any claims, losses, damages, liabilities, costs and expenses arising from your user of the service or any violation of these terms.

Splamei cannot be held liable for the following:

  • False positives or incorrect automated moderator action
  • Misuse of commands by moderators or users
  • Content posted by users
  • Any indirect or consequential damaged arising from your use of SplameiBot

SPLAMEIBOT IS PROVIDED ‘AS IS’, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS OR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT CAN SPLAMEI OR ANY AFFILIATED PARTIES BE HELD LIABLE FOR ANY CLAIM OF DAMAGES OR OTHER LIABILITIES ARISING FROM, OR IN CONNECTION WITH SPLAMEIBOT OR ANY FORM OF USE.

8. Governing Law and disputes

If you’re not happy with us, you need to let us know and have us resolve it privately first (in good faith) then, after after 30 days, you can take further action

These terms are governed by UK law. In the case of a dispute, you must resolve the dispute privately first in good faith. If the dispute cannot be resolved after 30 days, further action may be taken.

9. Data collection and usage

For information about SplameiBot’s data collection and usage, please refer to the SplameiBot Privacy Policy.

10. Termination

You can revoke your access to the bot at any time ending these terms. If you violate the terms, you must remove the bot and you’re access (ending these terms).

When terminated, sections 5, 6, 8 and 12 will still apply

You may revoke access to SplameiBot at any time without prior notice in which case these terms become void. In the case that you violate these terms, you must remove and revoke all your access to SplameiBot in which case, these terms will then become void. You must also reject the terms for all servers you have accepted the Terms of Service and Privacy Policy for using the /terms <Mass Reject> command.

To reject the Terms of Service and Privacy Policy for a specific server, you may use the /terms <Reject> command and for all servers, /terms <Mass Reject>.

In the event of a termination, sections 5, 6, 8 and 12 shall prevail termination.

11. Changes to these terms

When we update the terms, we’ll send a message on our server in the SplameiBot news channel and send you a DM letting you all know. You need to re-accept the terms to use the bot again once the enforcement date listed was reached. We’ll send you another DM if you miss this date.

We reserve the right to amend or update these Terms of Service and our Privacy Policy at any given time. When changes are made, a notification will be sent to the designated SplameiBot update channel in the official Splamei, SplameiPlay Discord server and a Direct Message sent to all users with Direct Messages open towards the bot, warning about the change and the enforcement date. A member of the server with the ‘Administrator’ or ‘Manage Server’ permissions must review and accept these terms on behalf of the server. Once the enforcement date is reached, another Direct Message will be sent to users who failed to accept the new Terms of Service and Privacy Policy before the enforcement date, and their access to SplameiBot and services will be suspended within those specific servers.

We keep all copyright and rights to SplameiBot. You can’t make, use, endorse, modify, copy, distribute or reproduce anything against the Splamei brands (i.e. SplameiPlay, Nimokion) without consent

The Splamei, SplameiBot, SplameiPlay and other associated Splamei brand’s name, logo, assets, code, works and identity is property of Splamei and SplameiPlay. We retain all rights to the ownership of these brands. You cannot make, use, endorse, modify, copy, distribute or reproduce any content that infringes on the copyright of any Splamei brand without prior consent from a valid copyright holder.

13. Content handling

When you use SplameiBot, we’ll log some things like command usage, errors and changes in the servers the bot is in. You can check out our Privacy Policy for more info

To help improve SplameiBot, all uses of SplameiBot will be logged including, but not limited to, uses of commands, errors and changes to the guilds (Discord Servers) that SplameiBot is in. For more information, please refer to the privacy policy.
